Terms and Conditions for Instagram Giveaways

§ 1 Organizer

(hereinafter referred to as "Organizer").

By participating, the participant accepts these terms and conditions as binding. These terms and conditions apply in addition to the Instagram terms of use.

Note: This giveaway is not affiliated with Instagram and is in no way sponsored, endorsed, or organized by Instagram. The sole point of contact for the giveaway is the Organizer.

§ 2 Eligibility

1. Eligible participants are natural persons residing in Germany who are at least 18 years old at the time of participation.
   
2. Only natural persons participating in their own name are eligible.
   
3. Employees of the Organizer and their relatives are excluded from participation.
   
4. Participation through automated services, sweepstakes clubs, multiple accounts, or other attempts at manipulation are excluded. Participants who violate these conditions will be excluded from the giveaway.
   

§ 3 Participation and Execution

1. The giveaway will take place exclusively via the Instagram account @mimi.milkwear.
   
2. Eligible to participate are those who, within the participation period 01.02.2026 - 08.02.2026,
   - follow the profile @mimi.milkwear
   - like and comment on the corresponding giveaway post
   - share the post in their story for an increased chance of winning
   
3. Multiple entries are not permitted; each participant may only enter once.
   
4. Participation does not incur any costs for the participant, apart from the usual connection costs of the respective internet or mobile phone provider.
   

§ 4 Period

The giveaway begins on 01.02.2026 at 10 AM and ends on 08.02.2026 at 11:59 PM. Entries submitted after the participation period will not be considered. The Organizer reserves the right to extend or terminate the giveaway prematurely if necessary.

§ 5 Prizes and Prize Values

1. The prize is 1 x a 100% discount voucher for the online shop www.mimi-milkwear.de.
   
2. Cash payment of the prize, as well as exchange or transfer to third parties, are excluded.
   

§ 6 Winner Determination

1. Winners will be selected by random drawing from all valid entries after the participation period has ended.
   
2. Winners will be contacted within 7 days after the entry deadline via Instagram Direct Message (DM).
   
3. If a winner does not respond within 7 days of notification, the prize claim will be forfeited, and a new winner may be drawn.
   

§ 7 Data Processing / Data Protection

1. The Organizer processes participants' personal data exclusively for the purpose of conducting and administering the giveaway and for prize notification.
   
2. For participation, at least the Instagram username and possibly further contact details (e.g., first and last name, delivery address, email) are collected – these will only be used for the processing of the giveaway.
   
3. The data of the winners will be deleted after the completion of the giveaway or the dispatch of the prize, unless legal retention obligations prevent this.
   
4. Data will not be used for advertising purposes, unless the participant has explicitly consented.
   
5. Further information on data protection can be found in our privacy policy.
   
6. Participants have the statutory data subject rights (e.g., access, rectification, erasure, etc.).
   

§ 8 Liability

1. The Organizer is liable without limitation for injury to life, body, or health, and for other damages only in cases of intent or gross negligence.
   
2. The Organizer assumes no liability for technical malfunctions, failures, or losses that are beyond the Organizer's control.
   

§ 9 Premature Termination / Changes

The Organizer may adjust, cancel, or terminate the giveaway at any time without prior notice if proper execution is not guaranteed for technical or legal reasons.

§ 10 Applicable Law, Exclusion of Legal Recourse

German law applies. Legal recourse is excluded.
